Job Purpose

The Consultant will lead and facilitate Best Interests Meetings (BIMs) for patients experiencing Prolonged Disorders of Consciousness (PDoC). The primary objective is to ensure that critical decisions regarding Clinically Assisted Nutrition and Hydration (CANH) are made in strict accordance with current clinical guidance, ethical principles, and legal frameworks. The post-holder will collaborate deeply with multidisciplinary teams (MDTs), patients’ families, legal representatives, and relevant healthcare professionals. You will ensure the decision-making process is entirely person-centred, legally robust, transparent, and meticulously documented—particularly in highly sensitive cases involving the continuation or withdrawal of life-sustaining treatment.

Key Responsibilities & Duties

Clinical Leadership & Decision-Making

  • Chair and facilitate BIMs: Lead complex Best Interests Meetings ensuring all legal, ethical, and clinical dimensions are thoroughly explored.
  • Guide CANH decisions: Provide expert clinical oversight on the continuation, withholding, or withdrawal of Clinically Assisted Nutrition and Hydration.
  • Synthesize evidence: Review and analyze comprehensive clinical data, diagnostic assessments, and trajectory formulations to inform robust decisions.

Stakeholder Collaboration & Advocacy

  • Engage MDTs: Partner closely with speech and language therapists, neurologists, occupational therapists, and nursing teams to align clinical findings.
  • Support families: Act as a compassionate, objective liaison for patients' families, helping them navigate stressful, emotionally heavy decision-making windows.
  • Capture patient voice: Rigorously investigate and represent the patient’s previously expressed wishes, moral values, religious beliefs, and lifestyle preferences.

Governance, Law, and Quality Assurance

  • Ensure legal compliance: Align all processes with the Mental Capacity Act (MCA) 2005, professional guidelines (e.g., RCP, BMA), and relevant case law.
  • Meticulous documentation: Author clear, legally defensible, and transparent formal reports detailing the rationale, dissent (if any), and conclusions of the BIM.
  • Mediate conflict: Provide expert conflict-resolution strategies when disagreements arise between clinical teams and families regarding the patient's best interests.

Person Specification: Experience & Qualifications

Essential Criteria

  • Medical / Clinical Qualifications: Full registration with the General Medical Council (GMC) or relevant professional body, with a current license to practice.
  • Specialist PDoC Expertise: Proven track record of managing patients with Prolonged Disorders of Consciousness (e.g., Vegetative State or Minimally Conscious State).
  • Legal Literacy: Deep, working knowledge of the Mental Capacity Act, Best Interests frameworks, and landmark rulings concerning CANH withdrawal.
  • Advanced Communication: Exceptional interpersonal skills with a demonstrated ability to manage highly emotive, confrontational, or sensitive discussions.

Desirable Criteria

  • Experience in Mediation: Formal training or extensive practical experience in clinical dispute resolution.
  • Agency Adaptability: Experience working as an external consultant or agency locum, requiring rapid assimilation into diverse NHS trusts or private healthcare frameworks.
